LEGAL

Terms of Use

These Terms govern use of Partsbank. Partsbank is operated by Tom Mc Carrick, trading as TMC Design (registered business number 540796), Doomore, Tubbercurry, F91 C982, Ireland. Contact: tmccar@mail.com.

1. The Partsbank service

Partsbank is an online marketplace where private and business sellers advertise vehicle parts and buyers contact sellers. Unless a listing expressly states otherwise, Partsbank is not the seller, does not own or inspect listed parts, does not set the sale price and is not a party to the contract between buyer and seller. Buyers and sellers arrange payment, delivery or collection directly.

2. Eligibility and accounts

You must be at least 18 and legally able to enter contracts. Information supplied must be accurate and kept up to date. You are responsible for your password and activity on your account. Contact us promptly if you suspect unauthorised access.

3. Seller status and consumer rights

Sellers must accurately identify themselves as an individual/private seller or a business seller. A business must not present itself as a private seller. Consumer protections may apply when a consumer buys from a business seller; they generally do not apply in the same way to a transaction between two private individuals. Nothing in these Terms excludes rights that cannot legally be excluded.

4. Listing rules

Sellers must have the right to sell each part and must provide accurate descriptions, condition, price, location, seller status and known compatibility information. Listings must not offer stolen, counterfeit, recalled, unlawfully obtained or unsafe items, or content that infringes another person’s rights. Photos must show the actual item unless clearly stated otherwise. Sellers must remove or pause unavailable items.

5. Vehicle compatibility and buyer checks

Vehicle compatibility information is supplied by sellers and is not guaranteed by Partsbank. Buyers should compare part numbers, vehicle specifications and photographs and confirm compatibility with the seller or a qualified professional before purchase or installation. Safety-critical parts should be inspected and fitted by a competent person.

6. Search results and featured listings

Search results are primarily filtered by the buyer’s text, category and selected vehicle details. Featured listings are placed ahead of standard listings; within those groups, newer published listings are generally shown first. Partsbank may change ranking to improve relevance, safety or service quality and will update this explanation if the main ranking method materially changes.

7. Listing fees

Partsbank may charge a fee to publish or feature a listing for a stated period. The price and duration are shown before payment. Stripe processes the payment. A listing fee pays for the advertising service only; it is not a commission or payment for the underlying part. Statutory cancellation and refund rights remain unaffected. If the paid publication service is not supplied because of a Partsbank fault, contact us for review.

8. Transactions and disputes

Buyers and sellers are responsible for agreeing payment, delivery, collection, inspection, returns and any warranty. Use caution, retain records and do not send money until satisfied with the counterparty and item. Users should first try to resolve transaction disputes directly. Partsbank may review reports and provide available account or message records where lawful, but is not required to mediate or compensate for user transactions.

9. Messages and acceptable use

Do not use Partsbank for harassment, fraud, spam, unlawful activity, malware, scraping, interference with the service or attempts to bypass security. Messages must relate to legitimate marketplace activity. We may investigate reports and restrict content or accounts where reasonably necessary.

10. Content licence and moderation

You retain ownership of content you submit. You grant TMC Design a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content solely to operate, promote and improve Partsbank. You confirm you have the necessary rights. We may reject, pause or remove listings or accounts that breach these Terms, create legal or safety risk, or undermine the marketplace. Where appropriate, users may contact us to ask for a decision to be reviewed.

11. Availability and liability

We aim to keep Partsbank available and accurate but do not guarantee uninterrupted service, successful sales, seller identity, item quality or compatibility. To the maximum extent permitted by law, TMC Design is not responsible for losses caused by another user, an off-platform transaction, inaccurate listing information or events outside reasonable control. Nothing limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that law does not permit us to exclude.

12. Privacy, suspension and termination

Our Privacy Policy explains how personal data is handled. You may stop using Partsbank at any time and may request account deletion. We may suspend or terminate access for material or repeated breaches, fraud, safety or legal risk, non-payment, or misuse. Provisions that by their nature should continue after termination will survive.

13. Changes and governing law

We may update these Terms as Partsbank develops or legal requirements change. Material changes will be notified appropriately. These Terms are governed by Irish law. The Irish courts have jurisdiction, without affecting any mandatory consumer right to bring proceedings elsewhere.
